Territory of Florida Middle District County of Gadsden Superior Court of Law

On this 7th day of May 1833 personally appeared before the Judges of the said Court in open Court John Daniel Senior aged seventy-five years, who being duly sworn according to law doth on his oath make the following declaration in order to obtain the benefit of the provision made by the act of Congress passed the seventh of June 1832.

That he volunteered in the service of the United States in the year __ with Colonel Sewall [sic, Benjamin Seawell?] and served in his Regiment, the same being militia, the name of the Captain and Lieutenant he has forgot he served at that time three months, he resided in Hertford County North Carolina when he entered the service, he fought no battle, he marched through North Carolina and part of South Carolina.

That he volunteered a second time in the year __ in the Army of the United States under Captain Saucer [could be "Lancer"], who commanded a company of militia, that he was Sergeant in the said company, that Colonel Kenan commanded the Regiment, that he served about seven weeks during the last period, he fought no battle during said period but part of the time guarded the Tories at Wilmington NC at the time he entered the service he resided in Dobbs County North Carolina, the Country through which he passed is between the County of Dobbs and Wilmington.

He hereby relinquishes every claim whatever to a pension or an annuity except the present and he declares that his name is not on the pension Roll of any agency in any State and that he has never received any pension.

And the said Petitioner being in open Court further interrogated on the following questions under oath gave the answers thereto respectively annexed.

1st Question --Where and in what year were you born?

Answer. I was born in Hertford County North Carolina in the year 1758 to the best of my belief.

2nd Question. Have you any record of your age & if so where is it?

Ans: I have none -- I have only my recollection of what I have heard from my Father & others on the subject.

3rd Intergy: Where were you living when you were called into the service: where have you lived since the Revolutionary war, and where do you now live?

Answer. When first called into the service I was living in Hertford County North Carolina when afterwards called into the service I was living in Dobbs County North Carolina. A few years after the Revolutionary War I removed from North Carolina to Georgia. In that state I resided until seven years back -- when I removed to Gadsden County Florida where I now live.

4. Interrogatory -- How were you called into the Service -- were you drafted, did you volunteer or were you a substitute?

Answer -- I was a substitute in both first for Kendred [?] Skinner and next for my uncle John Daniels [sic].

Five Interrogatory. State the names of some of the regular officers with the troops where you served, such Continental and militia regiments as you can recollect and the general circumstances of your service.

Answer. In my first Tour I served with Colonel Seawell & Lieutenant Colonel William Bricklain [?]. The second time I served under Colonel Kenyon -- I know nothing of any Continental regiments present when I served and can state no further material circumstances of my service except what is contained in the four born Declaration.

Interrg 6. Did you receive a Discharge from the Service --

Answer. I did not. In my first Tour I was left sic & from the expiration of my second tour was at an end & I was permitted to leave the service.

7 Interrg. State the names of the Persons to whom you are known in your present neighborhood, & who can testify as to your character for veracity & their belief of your services as a soldier of the Revolution?

Ansr: Mr. Woodbury a minister & David Patterson and they have also to refer to the Certificate of Appilles [?] Daniel hereto annexed. S/ John Daniel

I do hereby certify that John Daniel was in the Service of the United States during the Revolution of 76.
